The Trump administration filed an amicus brief in Zarda v. Altitude Express asking the Court to legalize discrimination against LGBT+ people in the workplace, arguing that the employment protections created by Title VII of the Civil Rights Act of 1964 do not apply on the basis of sexuality.
“Unfavorable treatment of a gay or lesbian employee as such is not the consequence of that individual’s sex,” the Justice Department argued, “but instead of an employer’s policy concerning a different trait—sexual orientation—that Title VII does not protect.”
The Supreme Court will hear oral arguments in the two Title VII cases on October 8.
Earlier this summer, Out Leadership partnered with other equality organizations to coordinate corporate signatories to an amicus brief in the cases arguing that the court should find that Title VII protects LGBT+ people from discrimination.
