The Department of Health and Human Services announced its intention to explicitly exclude gender identity and sex stereotyping/sexual orientation from section 1557 of the Affordable Care Act, which prohibits discrimination on the basis of race, color, national origin, sex, age, or disability in certain health programs or activities. “Sex” here has consistently been interpreted to include LGBT+ identities.
The proposed rollback would leave healthcare workers free to refuse to perform gender affirmation surgery and leave insurers free to exclude coverage of transgender healthcare. The rollback also includes religious and moral exemptions.
